Accused triple killer a ‘failure and coward,’ Crown says in closing

Ian Bush is a failure and coward who attempted to rewrite his own sorry history by tying up and murdering three people, a Crown prosecutor alleged in his closing arguments to a jury Monday.

Bush is on trial for three counts of first-degree murder in the slayings of retired tax court judge Alban Garon, his wife, Raymonde Garon, both 77, and their neighbour Marie-Claire Beniskos, 78. The three seniors were killed in the Garons luxury condominium on Riverside Drive on June 29, 2007.

In his closing address to a jury, prosecutor James Cavanagh argued that the accused killer was disgraced and humiliated in front of his family when it was revealed he owed his mother $60,000. Bush was angry at Revenue Canada for holding back money he thought he was owed when he decided to lash out at those he held responsible, said Cavanagh.

Crown seeks leave to appeal overturning of Dennis Oland’s murder conviction

Crown prosecutors say they will ask the Supreme Court of Canada to review the New Brunswick Court of Appeal’s decision to overturn Dennis Oland’s second-degree murder conviction in the 2011 bludgeoning death of his father, multimillionaire Richard Oland.

Prosecutor Kathryn Gregory revealed the Crown’s decision to seek leave to appeal to the country’s highest court on Tuesday in Saint John’s Court of Queen’s Bench.

She did not explain the grounds, but told Justice William Grant the Crown expects to file its application on Jan. 22, 10 days after the New Brunswick Court of Appeal is expected to release its detailed written reasons for its Oct. 24 decision to quash Oland’s conviction and order a new trial based on a “fundamental flaw” in the trial judge’s instructions to the jury.

A date for Oland’s new trial was expected to be set on Tuesday, but scheduling has now been adjourned
